IP Law for E-Cigarette Companies
Whether or not your startup e-cig company owns patents, trademarks, or copyright registrations, it is important to understand what these brand protections do and don’t do. Unwary startup companies, trying to distinguish themselves from competitors, are likely to fall prey to claims of infringement without the proper clearance. In this intellectual property (“IP”) law primer, attorney Linhda Nguyen will cover the basics of IP law, why IP adds value to a business, and how to avoid infringement. She will focus on trademarks and copyrights, as these topics are in the forefront of issues affecting e-cig companies.
Linhda is an associate in Merchant & Gould's Minneapolis office, where she primarily practices litigation and trademark prosecution. She represents clients in the electronic cigarette industry in matters ranging from trademark clearance to prosecution, enforcement and litigation. From her work with electronic cigarette startup companies, she is in a position to advise her clients on how to use intellectual property to create value in their businesses and to address the unique legal issues affecting the industry.
Linhda holds a J.D. from the University of Minnesota Law School. Born and raised in California, she received her B.S. in biochemistry from UCLA and worked as a research associate at the John Wayne Cancer Institute in Santa Monica prior to practicing law. It was at JWCI where she discovered her passion for technology and intellectual property. Linhda strives to use her litigation skills to protect her clients’ inventions. In her spare time, Linhda enjoys rock climbing, snowboarding, and paddleboarding.
