Brian practices predominantly in the areas of trademark and copyright infringement and anti-counterfeiting litigation in federal courts throughout the country. He has obtained favorable judgments in numerous trademark and copyright cases, often resulting in monetary recoveries, permanent injunctions and destruction of infringing goods. He frequently litigates domain name disputes under the Anticybersquatting Consumer Protection Act. His practice also includes opposition and cancellation proceedings before the Trademark Trial and Appeal Board ("TTAB") and before similar tribunals in other countries.

Brian has experience in all aspects of trademark prosecution, including clearance opinions, prosecution of trademark applications in the U.S. and in other countries. He counsels clients in all aspects of trademark and copyright law, portfolio management and maintenance, and licensing of intellectual property. Brian's practice areas include Trademark, Copyright, Internet Law, Licensing and Litigation.

Va. 2002) - Obtained permanent injunction and final consent order, in trademark infringement and ACPA action, requiring transfer of 229 domain names, assignment of infringing service mark application, and enjoining future use of any confusingly similar domain name or mark.

E.D.N.Y. 2002) - Obtained consent judgment and permanent injunction enjoining importation and distribution of counterfeit air fresheners and ordering destruction of infringing merchandise.

Levitt Homes, Inc. v. Life Investment Family Estate Ltd., Civil Action No. 9:2002 CV 80251 (U.S.D.Ct. S.D.Fla. 2002) - Obtained permanent injunction and final consent judgment in trademark infringement and unfair competition action ordering defendants to change name of residential housing development.

Big O Tires, Inc. v. Galaxy Tire & Wheel, Inc., Civil Action No. 98-WM-2340 (U.S.D.Ct. D. Colo.) - Obtained settlement in trademark infringement/cancellation action requiring defendant to cease all use of the mark and to surrender registration for cancellation.

Eden Hadden & Co. v. Sumitomo Trust & Banking Co., 16 USPQ2d 1187 (4th Cir. 1990) - Assisted in obtaining reversal of district court's denial of equitable remedy of disgorgement for breach of non-circumvention agreement.
