The Trademark Trial and Appeal Board has significantly amended its rules of practice governing cases before the TTAB.  These changes include allowing parties to put in testimony by affidavit instead of orally, requiring that almost all communications and filings be electronic, requiring that discovery be served and completed before discovery closes, and doing away with the five extra days to respond to papers served by mail.  In addition, the TTAB is making the changes effective for all Board cases, new and pending, as of January 14, 2017.  We will detail the rule changes, discuss strategic considerations in view of the changes, and highlight some of the complications imposed by making the changes apply retroactively.
