Since its inception as a provision under the America Invents Act, the inter partes review process has continued to evolve before the Patent Trial and Appeal Board.
The Merchant & Gould attorneys presenting this session have been involved in about 25 inter partes reviews, representing both petitioners and patent owners, both during copending litigation and in other competitive contexts. A number of these IPRs have been through final written decisions and are on appeal.
