Kerry Timbers is an intellectual property litigator and managing partner of Merchant’s Boston office. With more than three decades of experience, he represents clients in high-stakes patent disputes across a range of industries, including life sciences, medical devices, telecommunications, and consumer products. Kerry has litigated extensively in federal district courts nationwide and has argued before the U.S. Court of Appeals for the Federal Circuit. He also handles proceedings before the Patent Trial and Appeal Board (PTAB), including inter partes reviews and interference matters.
Kerry’s litigation track record includes multimillion-dollar verdicts, favorable settlements, and complete defense wins. Notable matters include securing a $14.6 million jury award for a medical device company and leading a successful defense that invalidated over 150 patent claims asserted by a non-practicing entity. He also advises on trademark enforcement, licensing, and portfolio strategy, and has represented globally recognized brands in infringement, opposition, and cancellation proceedings.
A trusted advisor to clients and a respected voice in the legal community, Kerry has held leadership roles with the Boston Bar Association and is a Master in the Boston IP American Inn of Court. He is a Fellow of the Litigation Counsel of America and an active member of the American Intellectual Property Law Association and the International Trademark Association.
